grandfathering

Preserving existing rights

Grandfathering is exempting existing cases from new rules or requirements.

When regulations change, those already engaged in an activity may be grandfathered in—allowed to continue under the old rules: The new licensing requirements don't apply to current practitioners; they're grandfathered in.

The term comes from post-Civil War voting restrictions that exempted men whose grandfathers could vote, effectively excluding Black citizens while protecting white ones.
