activist judge

Bench-based policymaker

A pejorative term for a judge whose rulings allegedly reflect personal political views rather than faithful interpretation of law.

Critics on both sides of the political spectrum use it to attack decisions they oppose: The court's ruling on abortion rights was denounced as the work of activist judges.

The term implies judicial overreach—that the judge is making law rather than interpreting it.

What counts as "activist" typically depends on who's doing the counting.
